스폰서 회사가 문을 닫았습니다.
I-140 까지는 승인받아서 다른 회사로 다시 들어가려고 한는데
priority date가 transfer되는지 변호사분들 넘 각각 다른 의견이라서…

혹시 그런 경험 하신분 있으신가요?

9 FAM 42.53 N3.6 Subsequent Petition in Employment-based Classifications

(TL:VISA-173; 11-10-1997)

a. Unless revoked pursuant to 8 CFR 205.2 for fraud or
misrepresentation, a priority date accorded by approval of an
employment based first, second or third preference petition is retained
by the beneficiary for any other first, second or third preference
petition approved subsequently for the same beneficiary. In all cases,
the beneficiary of multiple petitions is entitled to the earliest of the
filing dates of the various petitions.

위에 밑줄 친 곳의 정확한 의미가 파악되시는 분??
(저 부분ㅤㄸㅒㅤ문에 변호사님마다 의견이 다른것 같은데… )

회사가 문을 닫으면 8CFR 205에 의해 automatic revocation은 되는걸로 압니다.
하지만 fraud 나 misrepresentation 아닌면 기존 PD를 재사용할수 있다는 의미인지?
아님 8CFR 205에 의해 I-140이 취소된 경우는 모두 불가능하다는 의미인지…
