안녕하세요. I-140을 NIW 분류로 혼자 작성하고 있는데 궁금한 점과 확인할것이 있어서 몇자 적습니다. 고수님들께서 꼭 한번 리류를 해주시면 감사하겠습니다.

저는 현제 OPT로 학교에서 포닥을 하고 있습니다. 12월 18일에 12개월 OPT가 끝나고 몇일전에 OPT 연장 서류를 보냈는데 지금 기다리고 있습니다.

본론으로 들어가서

Part 1.

1. IRS Tax No. 은 NIW인 경우는 안 적어도 된다고 했는데 맞나요?

Part 3.

1. 마지막에 나오는 if in the U.S.내에 Date of Arrival은 최근 i-94에 나오는 입국날자를 쓰면 되남요?

Part 4.

1. Alien is in the United States and will apply for adjustment of status to that of lawful permanent resident.

Alien’s country of current residence or, if now in the United States, last permanent residence abroad.를 체크하면 되고 밑에 south Korea라고 쓰면 되남요?

2. If you provided a United States address in Part 3, print the person’s foreign address: 요건 한국집주소 쓰면 되구요.

3. If the person’s native alphabet is other than Roman letters, write the person’s foreign name and address in the native alphabet: 요건 한글로 한국집주소 쓰면 되구요.

4. Are any other petition(s) or application(s) being filed with this Form I-140? No 했습니다. 나중에 140 receipt 나오면 485+ receipt(140) 를 넣을려구요.

5. Is the person for whom you are filing in removal proceedings? 당연히 NO겠죠.

6. Has any immigrant visa petition ever been filed by or on behalf of this person? 이민바자는 처음이라서 당연히 No.

7. Is the petition being filed without an original labor certification because the original labor certification was previously submitted in support of another Form I-140? – NIW 라서 당연히 No

8. If the petition is being filed without an original labor certification, are you requesting that USCIS request a duplicate labor certification from the Department of Labor? – NIW 라서 당연히 No

Part 6

5. Is this a full-time position? 저는 full-time 포닥이니깐 당연히 YES

6. Is this a permanent position? 포닥이 계약직이라서 당연히 No

8. Is this a new position? 첫 포닥이기에 당연히 YES 이겠지요?

Part 7.

제가 와이프만 있습니다.  지금 같이 미국에 있죠. 그런데 듣기로는 140는 본인만 해당되는거라는데 그럼 Part7을 빈칸으로 남겨도 된다는 의미인가요?

만약에 가족신상을 part 7에 넣여야 한다면

Applying for Adjustment of Status 은 YES이고

Applying for a Visa Abroad은 NO 겠죠?
