안녕하세요. H1B transfer에 대해서 너무 몰라서 묻습니다.
저는 H1B 소유자였고 I-94는 2010-01-08일까지가 유효일자입니다.

회사가 너무 어려워져서 지난 10월말에 해고 당했습니다. 지금 까지 잡써치중 어제 한 조금한 컨설팅 A업체에서 오퍼를 받았구요.
그리고 제가 정말 가고 싶은 B회사에서는 온싸이트 인터뷰만 남아 있구요.
문제는 B회사에 되서 가고 싶은데 A회사는 당장 다음주 부터 일하자고 합니다.

A회사의 오퍼는 아직 사인은 안했지만 내일 중으로 사인 및 H1B 트랜스퍼도 진행해 주길 원하고 있구요. 사인을 하면 B회사와의 인터뷰가 쉽지는 않겠지만 계속 진행할려고 합니다.

문제는 A회사로 H1B 트랜스퍼를 해버리고 나면 나중에 B회사로부터 오퍼를 받았을 경우 당장 트랜스퍼를 할 수 있나요?
그에 따른 어떤 조건이나 패널티가 있다면 다시 H1B를 다시 잡기가 정말 어렵지만 그냥 A회사의 오퍼를 취소하고 B회사랑 결판낼 생각 중인데요.

인터넷에서 관련글을 찾아보니 2가지 경우의 얘기가 나오더라구요. 어떤게 맞는지 모르겠습니다.

혹시 변호사님이나 아시는 분 계시면 어느쪽이 맞는지 도움을 주시겠어요.

(1) 이쪽 웹싸이트에서는 H1B 받자마자 다시 트랜스퍼 할 수 있다고도 하고 여러군데 동시에도 할수 있다구 하네요.

2) Upon approval of H1B transfer, is there any time limit to join the new company?
Once your H1B transfer is approved, there is no joining time limit. It is totally up to you, when you want to report to work for the new Company.

6) Is there any limit for the number of times I transfer my H1B visa?
No. There is no such limit, you can apply for as many H1B transfers as you want.

7) Can I apply for an H1B transfer through more than one company at the same time?
Yes!

1) Can company B apply for transfer of H-1B visa, while I am in India, or does it need to apply for H-1B again?

Company B cannot apply for your H-1B transfer, unless you enter the US and spend three months with company A.

2) I have a valid H-1B visa for company ABC. Now, company XYZ is willing to transfer my H-1B. I’m still in India and have not landed in the US. Is it imperative to get a clearance letter (no objection letter) from my first company i.e., ABC, which filed for my H-1B papers? Do I need to start work for company ABC, or can I start working for company XYZ, which is willing to transfer my H-1B, immediately after I land, without working for company ABC for a single day?

Please note, that to the best of my knowledge, legal transfer of the H-1B visa can take place only after a person lands in the US and commences employment with the organisation which applied for the visa. Hence, you will not be able to transfer your visa without working for company ABC for a minimum period of three months
