I-140 & I-485 EB-1 file 과 동시에 H-1B file

    복잡한 문제가 있어서 문의를 드립니다.

    현재 O-1 비자로 회사에서 일하고 있습니다.
    올 8월 말로 O-1 기간이 만료가 됩니다.

    회사에서는 5월 달 안에 EB-1으로 I-140 와 I-485를 동시 화일 한다고 합니다. (서류는 다 준비 되었고, 변호사 사무실에서 마지막 점검 중입니다.)
    그러면 약 60일 안에 (7월 말이나 8월 초) EAD가 나오니 문제 없다고 합니다.

    O-1은 dual intent?를 가질 수 없어,
    O-1 renew는 별 의미가 없다고 하네요.

    근데, 회사에서 EAD를 받아도 최종 영주권 승인은 혹시 모르니
    올해 쿼터가 아직 남았으니 H-1B도 신청하자고 합니다.
    이게 괜찮은 것인가요?

    H-1B는 10월 1일이 시작일이라 O-1이 만료되는 8월 말과 1개월 갭이 있는데요.

    I-485를 화일하고 O-1 에서 H-1B 로 체류 신분 변경을 신청 하는 것이
    문제 없는 것인가요?

      그러면 약 60일 안에 (7월 말이나 8월 초) EAD가 나오니 문제 없다고 합니다. –> It is not true. Nobody can gurantee that EAD can be issued in 60days. some get less than 4 weeks, others get even longer than 120days. No rules. Only luck. You should be prepared with 120days considering any bad case. Your company cannot control the USCIS.

      O-1 renew는 별 의미가 없다고 하네요. – not true, if your company has no objection to renew, there is no problem in renewing, it is entirely up to your company. O-1 is an non-immigrant visa that can be renewed with no limited time. You can renew as many times as you want as long as your company permits That is different thing from H1b. I think that your sponsor feels it is easier to control you using H1b than o1.
      If I were you, I will request the sponsor to renew o-1. Then apply 140/485. In this way, you do not have any such a gap.

      한가지 불편한 점이 있다면, O-1은 처음 3년이 지나면, 일년단위로 매년 갱신해야합니다.
