H-1B cap filings have reached to the Quotas.

    I just got an email from my immigration attorney saying that the H-1B cap filings have reached to the Quator and there will be a news release later today by USCIS confirming that it has received a sufficient number of cases that exceeded the given quator between April 1, 2009, and April 7, 2009. The “lottery” will be based on petitions received all five days.

      I think your lawyer’s suspicious. AILA just announced the opposite news. If the cap has been met, USCIS wouldn’t accept any more petitions. According to your lawyer, USCIS should stop receiving petitions, but they said they will continue to accept petitions. Either your lawyer told you an fiction-based assumption, or you’re spreading a rumor;;;

      I just reconfirmed with my lawyer wishing he could be wrong but unfortunately, they will soon have a news release to notify that they stop receving petitions and start the lottery process. Please see the other report on this that I posted above.

      I read new articles, but it is only from your lawyer that tells the cap has been reached.
      It’s good that your lawyer’s wrong, but I just wonder where he/she gets this wrong information and tell you with assurance.

      I think you don’t know what exactly happened last year. Accroding to my lawyer, It took at least 3-4 business days to count the received petitions that have been filied since April 1st. Which mean even if the final receipt counts will be different from what they assume they have recevied and it already exceeds the quotas, they don’t release the exact number because they can’t at this point.
