H1-B 신청했습니다. 10월 전에 한국 갔다와도 될까요?

    안녕하세요?
    이번에 H1-B 신청했습니다. 지금은 F-1으로 학교 다니고 있구요.. 6월에 졸업합니다. OPT도 신청한 상태입니다.

    변호사 사무실에서 이멜이 왔는데, 10월에 확정되기 전까지는 국외 여행 하지 말라 하네요.. 정말 중요한 일로 6월에 한국 다녀와야 하는데.. 큰일입니다. 뭔가 방법이 없을까요?

    We discourage traveling abroad after the petition is filed. If you travel after the petition is filed, you will be abandoning the request for a change of status, which means you would have to travel abroad again and obtain an H1B visa stamp to “activate” your H1B status. Additionally, you may have problems returning to the US in F1 status. USCIS has the discretion to reject your entry and send you home, since obtaining an H approval shows an “intent” to remain beyond the duration of the F.  The F status is truly temporary, meaning there should be no intention to remain in the US for a longer term. While CIS will approve changes of status from F to H, international travel should not take place unless the individual plans to travel and apply for the H visa stamp for his/her return. The earliest the Embassy will issue a stamp is 9/21 (10 days prior to the validity of the H status).

      May students travel outside the United States during a cap gap extension period and return in F-1 status?
      The regulations at 8 CFR 214.2(f)(13) state that a student who has an unexpired EAD issued for post-completion OPT and who is otherwise admissible may return to the United States to resume employment after a temporary absence. By definition, however, the EAD of an F-1 student covered under a cap gap extension is necessarily expired. As a result, if the student elects to travel outside the United States during a cap gap extension, he/she should be prepared to apply for an H-1B visa at a consular post abroad prior to returning. As the H-1B petition is presumably for an October 1 or later start date, the student should be prepared to adjust his/her travel plans, accordingly.
