제가 140 승인후 485 를 기다리는 중인데 H 비자는 만기가 됬고 현재 EAD 로 일을 하고 있는데 금명간 LAID OFF 될것 같습니다.
만일 이상태에서 회사를 나가면 얼마동안 안에 다른 JOB 을 찾아야 GRACE PERIOD 같이 485 승인에 문제가 없을 까요?
if your i-485 is pending more than 180 days, you can invoke AC 21 and find new ‘similar’ job’. if not and your sponsor company won’t hire you back when you get GC, then you have to start from begining from LC. Since your H1b was expired, i am not sure this option is available for you. Because as soon as uscis reject your i-485, your status will be illegal.
Anyhow there is no grace period because your i-485 is pending. However having continuous job record is always better. Talk to good lawyer. Cheers
