In January of 2009, The Province if Alberta Canada announced that they had officially approved a remarkable program allowing United States H1B holders to gain Canadian Permanent Residency under a fast Track Program.

The Program does NOT require the H1B holder to have Job, Employer or Sponsor. The H1B holder can apply independently.

The Program is on a Fast Track and will generally take 12 months for Permanent Residence Status.

The Applicant must be currently working in the United States in one of the following temporary skilled worker visa categories: H-1B, H1-B1, H-1C, E-3

You must have a minimum of one year of work experience in the United States in one of the qualifying visa categories listed above.

Your current occupation must be on the AINP Occupations Under Pressure List for the Strategic Recruitment Stream – U.S. Visa Holder Category

Making a determination of a qualifying Occupation may require an expert analysis of your background. We offer a free analysis to determine if you do qualify for our Program. Please contact us for more information.
    Frequently Asked Questions

    1. Q: Does filing for Canadian Permanent Residency have any negative impact on my current H1B?

A: NO. Neither the application nor approval of your Canadian Residency will create any conflict with your current H1B.

    2. Q: My H1B job Title is not listed on the Regional Occupation list. Am I still eligible for a Canadian Green Card?

A: YES. If your job title is not found on the list, we will assist you in looking closely at your job duties to determine if your job duties themselves support an occupation on the list in order to qualify you for the Fast Track Alberta Program. Alternatively, Canada offers many other programs for professionals that you may qualify for as an alternative to the Alberta program.

    3. Q: I understand that I do not need an Employer to file for my Green Card under the Alberta Program. What if I do find an employer? Does this make a difference?

A: YES. The actual process to obtain your Permanent Residency Card will be exactly the same. Approximately one year with or without an employer. However, if you do have an employer, we can assist you with filing for special permission (work permit) to begin working with your new employer during the waiting period.

    4. Q: Once an applicant is accepted and approved by the Alberta Province, does that mean his Permanent Residency application is also approved?

A: NO. The Alberta Province makes the preliminary approval of your application. ( Approx 6 months.) You are applying for Canadian permanent Residency. As such, the Federal Government must also approve your case. We will file BOTH applications for you.

    5. Q: Does receiving the Canadian Green Card guarantee me a job?

A: NO. The application process does not include any type of employment recruitment for you. However, Alberta reports that they have predicted that they will have a 100,000+ skilled worker Shortage over the next ten years.

    6. Q: Once I am a Permanent Resident of Canada, can I ever apply for an H1b again?

A: YES. As long as you have not violated U.S immigration laws, you can always re-apply for a U.S work visa if that opportunity presents itself. Further, once you are a Canadian Citizen, you may be eligible for a special U.S/Canadian authorized visas such as the TN working visa.
