EIC 의 자격을 정확히 알고 싶어요.

    남편은 H1B로 계속 세금보고 하다가 학생으로 바꿔서 보고하는데 소셜있고요, 저도 일할수 없다가 안찍혀있는 소셜넘버있고요,
    아이둘도 이곳서 태어나지 않았지만 소셜이 있어요.

    5년이 넘어서 그리고 소득이 많지않아 제가 늘 온라인 터보로E FILE을 해 왔어요.
    그리고 아이들 시민권자냐 묻는 항목에서는 항상 “NO”라고 했구요.

    그런데, 이번엔 터보에 그런메세지가 뜨더라구요. EICT의 자격조건 중에 시민권자나 영주권자여야 된다…..

    소셜있는 우리아이들과 두 부모가 영주권자는 아니지만 소셜이 있고, 5년을 헐 넘게 텍스내면서 살았다는 전제하에 제가 이제까지 EIC를 받았는데, 뭐가 잘못 된 것 같기도 하고…

    정말 정확한 EIC의 자격을 알고 싶어요.

      from IRS website
      You must meet the following EITC requirements:

      Must have a valid Social Security Number
      You must have earned income from employment or from self-employment.
      Your filing status cannot be married, filing separately.
      You must be a U.S. citizen or resident alien all year, or a nonresident alien married to a U.S. citizen or resident alien and filing a joint return.
      You cannot be a qualifying child of another person.
      If you do not have a qualifying child, you must:
      be age 25 but under 65 at the end of the year,
      live in the United States for more than half the year, and
      not qualify as a dependent of another person
      Cannot file Form 2555 or 2555-EZ (related to foreign earn income)

      h-1으로 못받는데요.. 저도 군침만 잔득흘리고 말았지요….

      h1이라서 못받는게 아니고 부모중 한쪽이 valid한 소셜넘버가 없기 때문아닐까요?

      그리고 영주권자가 아니여도 택스상 resident가 되고 다른 조건이 만족하면 받을수 있는것으로 압니다.
