현재 EB2 NIW I-140/485 동시접수 준비중입니다. 서류준비 막바지에 변호사한테서 이런 메일을 받았네요:
Please note, your birth documents are consulate-issued. USCIS does not accept consulate-issued documentation. According to the reciprocity schedule for South Korea, new forms of family register certificates are issued by the competent government offices, Ward offices, City halls, Myun offices, Eup offices, and Dong offices, throughout the country when the individual and his/her immediate family members (parents, children, or spouse) apply for the issuance of these certificates (please see the following website: http://travel.state.gov/content/visas/en/fees/reciprocity-by-country/KS.html). Please confirm if you are able to obtain your birth documents from South Korea.
요약하자면 영사관발행 출생증명서류는 USCIS가 받지 않는다, 직접 한국에서 받아올수 있느냐 인데요.
여기 다른분들처럼 엘에이 영사관에서 기본증명서와 가족관계 증명서 발급받아 영문 번역하고 번역공증까지 받았습니다. 아무리 찾아봐도 영사관 발행 증명서를 USCIS가 받지 않는다는 얘기는 없네요. 직계가족이 한국에 없고 직장때문에 당장 한국에 갈 수도 없는 상황입니다.
변호사측에서 뭔가 잘못알고 있다고 생각되는데요. 혹시 잘 아시는 분 있으시면 답변 부탁드립니다.
