Legal right to work in the US?

    온사이트 인터뷰를 앞두고 있고요, 가기전 application for employment form을 작성하고 있습니다. 그런데 항목중,

    Are you able at the time of employment to submit verification of your legal right to work in the US? (Verification and completion of Form I-9 must be submitted no later than three business days after date of hire.)

    라고 묻는데요.. Yes로 대답해도 되는거죠?

    제 상황은 아직 졸업하지 않은 대학원생이고, OPT로 취업 후 H1으로 변경하려고 합니다.

      많은 분들이 하시는 질문인데요. 아주 엄밀하게 따지자면 legal right는 “permanent” work permit을 가지는 영주권자 이상을 뜻합니다만 조금 느슨하게 적용하자면 OPT나 영주권신청과정에서 받는 EAD카드 소지자도 포함될수 있습니다.

      legal ramtification is that you are legally eligible for employment if any type of work permit, including OPT has been granted prior to or by the time of employment. However, employers reserve the right not to hire you based on their discretion. This means, you have the legal right to apply for jobs with OPT, but the employer might say, “we’re not going to offer H-1, and we’re looking for a long term employment. Thus, we won’t offer the job to you.”

      Yes!!!! You don’t need to worry about that at this stage. HR will follow up with Visa status in the middle of screening process.

      OPT has the legal right to WORK IN THE US. I-9,W-2 forms are authorized with OPT. BUT make sure you get SSN & EAD card when you apply of OPT.
