변호사의 역할을 제대로 하려면 (1) 정확성 (2)정직성 (3) 정의감 “3정(정)”을 갖추어야 합니다. 이 세 가지 요소는 서로 연관이 되어 있어서 셋 중 하나만 미흡해도 나머지는 와해됩니다. 정확 하지 않으면 정직할 수 없고 약자를 돕는 정의로운 행동을 취할 수 없습니다.

저희 사무실 대표 변호사인 임병규 변호사가 후배 이민변호사들에게 강의를 할 때 항상 강조하는 세 가지 덕목이 “3정”입니다. 실제로 각 분야에서 성공한 법조인들을 보면 모두 이 세 가지 덕목을 갖춘 사람들입니다.

둘째, 경험입니다.

아인슈타인 (Albert Einstein) 은 “경험이 유일한 지식의 원천이다 (Experience is the only source of knowledge)” 라고 갈파했습니다. 누구든 경험을 쌓지 않고 지식을 얻을 수 없다는 진실을 말한 것입니다. 줄리어스 시저 (Julius Caesar) 는 “경험은 만인의 스승 (Experience is the teacher of all things)”이라고 갈파 했습니다.

어느 분야에서 가장 많은 경험을 쌓은 사람이 그 분야의 가장 유능한 스승이 된다는 것이지요. 경험은 돈을 주고 살 수도 없고 빌려 쓸 수도 없습니다. 미국 이민법도 이 진리에서 벗어나지 않습니다. 비자 문제, 특히 거절 된 비자 문제를 맡기실 때는 Einstein 과 Caesar의 명언을 생각해 보는 것이 도움이 될 것입니다. 임병규 대표 변호사는 32년간 미국이민법과 같이 해온 경험자입니다.

셋째, 인맥입니다.

누구든 어느 분야에서 오래 일하다 보면 그 분야에서 지도적인 역할을 하게 되고 그러다 보면 자연히 그 분야의 영향력 있는 사람들과 인맥이 형성 됩니다. 입병규 대표 변호사는 86년에 미국이민변호사협회 뉴욕지부의 “변호사윤리 위원회)” 위원장직을 수행한 것을 비롯하여, 회원 2만명이 넘는 “뉴욕 주 아시아-태평양 변호사협회장”, New York Law School 총 동창회 이사 (아시아계 최초), New York County 변호사 협회 이사 (아시아계 최초), 미국 국무성 아시아 정책 자문 위원 등 자원 봉사를 통하여 인맥을 형성했습니다.

2009년에는 전직 이민국 국장대리 (USCIS Acting Director) 겸 이민국 법률고문 (USCIS General Counsel) 이었던 Robert Devine 변호사와 Co-counsel (공동변호인)이 되어 어려운 비자 문제를 해결 한 사례도 있습니다. 2015년 3월에는 미국이민변호사협회 회장인 Leslie Hollman 변호사의 요청에 의해 Opinion Letter (법률 의견서)를 작성 해 준 결과 맡았던 케이스가 승인되어 감사하다는 메일을 받았습니다. 비자 케이스를 맡길 때 맡는 사람의 인맥을 고려하는 것도 중요합니다.

넷째, 이민변호사는 상업적이 아니고 봉사 정신이 있어야 합니다.

이민변호사가 상업적인 면을 중시하다 보면 사실이 아닌 홍보와 마케팅에 치중하게 되고 증가하는 케이스를 처리하기 위하여 경험이 부족한 변호사들을 투입하게 됩니다. 하지만 2년 정도 경험이 있는 변호사가 5명이 일한다 해도 그 분들의 경험이 5 X 2, 10년 경험의 효과가 나타나진 않습니다. 경험은 여러 변호사의 경험을 합산 할 수 없는 것이지요. 저희는 홍보와 마케팅은 신경 쓰지 않고 그 대신 법률연구에 시간과 노력을 경주하면서 맡는 케이스의 수량을 줄여 한 케이스 한 케이스마다 주의를 집중합니다.

다섯째, 합리적인 봉사료를 받는 변호사를 택하시는 것이 중요합니다.

마케팅에 치중하면 대량으로 케이스가 몰려들고 그에 비례하여 높은 봉사료를 받게 됩니다. 반대로 너무 낮은 봉사료를 받는 사무실은 의뢰인이 없어 가격 다운을 해서라도 케이스를 맡아야 하는 경우가 많고, 봉사료를 작게 받은 케이스는 소홀하게 마련입니다. 가장 이상적인 것은 경험과 실력이 있으면서 너무 높거나 낮지 않는 합리적인 봉사료를 받는 곳을 선택 하는 것입니다. 그늘집은 봉사료를 책정하는데 세 가지 원칙을 적용하고 있습니다.
