    We helped a toxicological expert in the field of styrene toxicology research receive CIS Approval of EB2NIW Petition.
    Lately, our law firm helped a researcher in styrene toxicology research who had 12 published papers, obtain an approval of his NIW petition in 4 months and 4 days without a Request for Evidence (RFE).
    The client (case number: S-1293) received a Ph.D. degree in Pharmaceutical Analysis from a university in China.  He currently works as a Research Scientist at one of the leading research institutes in the U.S.
     
    The alien is currently working on key NIH projects to discover new metabolites and mechanisms to enhance the safety of styrene and styrene-made products.  The nature of his research is specifically geared toward the welfare of people all around the world.  Styrene is a widely used industry material in plastic and rubber production.   Its products have been used in industry and daily life, almost everywhere, such as packing materials, heat insulation materials, pipes, containers, rubbers, etc.  Styrene was found to be pneumotoxic and hepatotoxic in humans and animals.   The susceptibility of common people exposed to styrene with regard to cancer has been disputed among scientists.  Workers in styrene-related industries are exposed to a high level of styrene.  Despite the enormous amount of research currently being applied in the field of styrene toxicology, scientists have not yet totally understood the mechanism of styrene-induced toxicity.   There are still wide disputes on styrene carcinogenicity, neurotoxicity and genotoxicity between industry and academia, as well as public health regulators and environmental protection regulators.  Therefore, research of styrene toxicity is necessary and vital for both occupational health and public health in the U.S.   The applicant’s work on styrene toxicology research and his future endeavors in NIH-funded projects has been and will continue to be impactful on toxicological research of styrene and public health in the U.S.
     
    We demonstrated that the alien plays a critical role in the mechanistic study of the styrene-induced toxicity projects.  The applicant’s current research position requires his prior discoveries on novel styrene metabolites and related metabolism enzymes, and their importance in styrene-induced toxicity, in order to further the NIH projects.  In other words, his knowledge/experience of styrene metabolism and protein covalent binding methodology allows him to optimize his current research on the mechanistic study on styrene-induced toxicity.  The applicant’s work will help us understand the mechanism of styrene-induced toxicity in the liver and lungs.  This is crucial to the public health and relevant policy making in the United States.
    We helped the applicant establish that his research achievements have some degree of impact/influence on the field as a whole, as described above, by documenting his 12 journal and conference proceeding papers, approximately 22 research citations, invitations for peer-reviewed services, and 5 expert opinion letters, among other documents.  
     
    The successful adjudication of the client’s EB2NIW petition in 4 months and 4 days without a RFE reflects the fact that all the evidence and documentation of his case were thoroughly prepared and well-argued by our evidence preparation system according to the legal requirements of EB2NIW, which is very important for successful case results.
    The EB2NIW applicants who are outside the United States (e.g. in Korea) do not need a U.S. employer to sponsor a green card application.  However, the applicant needs to have a U.S. institute provide a ‘Letter of Intent to Offer’ to USCIS to prove that he/she will be offered a research position in his/her field of specialty in the United States after obtaining a green card.
