정말 헷갈리는 말들이 많아서요..

어떤분들은 H1B 에서 영주권을 본인들이 변호사 찾아서 한다는데,

더군다나 이민법이란 연방법이라서 제가 어디에 살든(참고로 저는CA거주자)

다른 주의 변호사를 찾아서라도 가능하다고 하는데 도대체 이해가 안가네요.

–> For example, for your personal lawsuit in your state, you will

need to hire a lawyer in your state, because laws are different by states.

However, INA is federal, so that any lawyer in the country will represent

you or your employer with same INA.

저는 큰회사에 다니고 있는데요, 처음 H1B로 Offer에 사인할때 영주권도

회사에서 Sponsor해주는 조건이었거든요.(SW engineer)

제가 궁금한것은, 회사에 상관없이 저 혼자서 H1B의 자격으로 영주권을

진행해나갈수 있는것인지입니다.다시말해 변호사 비용을 내가 지불할용의가

있다는 말이지요.

가능한지요?

그리고 가능하다면 어떤 절차가 필요한건지요?

–> I would say "Not possible." There are two issues: whether your

employer signs on the paperworks, and who is responsible for all the

expenses.

In INA, "Sign" means "Sponsor." It means that company officially sponsor

you for your green card by signing the papers. Without it, you will not

get your green card. As lon as your employer decides to sign, the second

problem is financial problem. If your employer is kind enough to pay all

the expenses, it’s more than enough.

It’s the second matter who is responsible for expenses. The first matter

is whether your employer will sign or not.

지금 현재 911이후로 저희 회사의 영주권 진행이 거의 대부분 Hold상태이거

든요..저희 회사는 어떤 식으로 진행되어 왔냐면, 광고하고 시민 몇명 뽑고

그러면 H1B 를 영주권 줄수 있는 quota가 생기고 뭐 그렇게 되었다고 알고

있습니다만…거의 2년여간 신규채용이 없어서 quota가 작년에 이미 다 소진

되어버렸다더군요.

–> There is no legal quota for H-1B and LPR(Lawful Permanent Resident)

in an individual company. It must be a policy of the company. It’s up to

you to solve the problem in this situation.
