    안녕하세요~
    전 2007년 7월에 영주권(I-485) 넣은후 pending상태로 이번에 i-131 신청후 다른나라(Haiti) 에 의료봉사를 다녀올려구 합니다
    몇가지 궁금하고 헷갈린게 있어서요…

    1.Part1 – class of admission 에는 어떻게 적어야 하나요? Adjust Status라고 적는건가요?

    2, Part 2 에는 어떤항목에 체크를 해야하는지
    a. I am a permanent resident or conditional resident f the United States, and I am applying for a reentry permit.
    d. I am applying for an advance parole document to allow to me to return to the United States after temporary foreign travel.
    f. I am applying for an Advance Parole Document for a person who is outside the United States.

    제 생각엔 a 아님 d 인거 같은데 이번에 I-131 신청후 한국을 다녀온 친구가 자꾸 f 라는거에요..전 지금 미국에 있는데 F 는 아닌듯…

    3. 아 그리고 Instructions 을 읽다보니깐 humanitarian parole 은 또 part 2에서 e or f 를 체크도 해야 되고 fee도 안내고 그렇던데 제가 그 경우에 해당할수 있을까요??
    전 나중에 한번더 한국을 갈 생각이라 그냥 일반적인 상황으로 했음 하는데요..
    친구 말로는 한국 아닌 다른 나라는 들어올때 문제가 된다고 잘 알아보고 하라고 해서요..

      전문가의 답변이 필요하겠지만…

      1번은 입국시 status라는 의견이 많던데(B1/B2 이런거요..).. 안적어도 된다는 의견도 있더군요..
      2번은… 잘 모르겠는데.. a는 아닐겁니다. 이건 확실한 resident만 되는거고 pending 상태는 advanced parole이 맞을듯 합니다..

      그리고 i-131 instruction 문서 보시면 advanced parole이 필요없는 경우가 나오는데, 485 pending이면서 H, L, K, V 비자가 돌아올 기간까지 유효하면 안내도 되는걸로 되어 있습니다.

      instruction을 보시고 확실치 않으면 USCIS나 변호사에 문의해보시는게 좋을듯 합니다.

      1. 현재 I-485를 신청한 상태이면 ‘AOS Pending’이라고 쓰십시오.

      Class of Admission

      이 용어를 그대로 보자면,
      입국 허가 때 받은 체류신분의 종류를 말합니다.
      즉, I-94에 적어준 F1, F2, H1B, H4, L1, L2, E2 등이요.
      쉽게 생각해서 입국 때 사용한 비자의 종류라고도 할 수 있습니다.

      그런데, 아래 설명에 의하면
      사실 이것은 입국시에 받은 체류신분을 묻는 것이 아니라
      현재 체류신분을 묻는 것이라고 합니다.

      그래서, 이 변호사의 말에 따르면,
      F1으로 입국한 후 H1B로 체류신분 변경을 했다면
      H1B로 쓰라고 합니다.

      Class of Admission Defined by USCIS

      We have recently had a number of clients, as well as MurthyDotCom and MurthyBulletin readers, ask us what the USCIS means by the term “Class of Admission” on the new Form I-131, Application for Travel Document. The USCIS has confirmed that they are seeking the applicant’s current immigration status. They are not looking for the status at first or most recent entry to the U.S., if different from the current status. For example, if a person entered the U.S. through a Port of Entry and was granted F-1 status, but later changed his or her status to H1B from within the U.S., the correct answer on the form for Class of Admission is H1B.

      It is unclear why the USCIS decided to change the phrasing of this question. We appreciate that they have clarified the definition so that we are better able to assist our readers and clients in providing accurate information to the USCIS.
