작년 회계연도말 부터 약7개월동안 취업이민3순위 영주권 문호 우선일자가 급진전되었으며, 이로인하여 취업이민 신청(I-140)이 크게 증가하였습니다.

신청인은 TBI 신경계 반응의 신호전달과정(signal transduction)을 연구하고 있습니다. 미국에서는 일년에 1백40만 여명의 일반인들이 차 사고 등으로 외상성 뇌손상(traumatic brain injury; TBI)을 입게되며, 또한 많은 군인들이 전쟁의 상처로 갖게되는 외상성 뇌손상과 연관된 장기적인 장애를 겪고 있습니다. 뇌세포의 신호전달과정 이해는 미 국익에 중요한 의미를 가지고 있습니다. 신청인의 연구는 새로운 외상성 뇌손상 탐지방법 및 개선방법들을 개발하고 더 나은 보호장비를 디자인하는데 공헌하는 것을 목적으로 합니다.

신청인의 연구 성과가 연구분야에 총체적으로 상당한 정도의 영향력을 주었다는 점을 증명하기 위하여, 14편 저널논문, 18편 학회발표 논문, 리뷰/연구 인용기록, 추천서 6부 등을 서류화하였습니다.

As the Visa Bulletin stated, since the end of fiscal year 2013, the worldwide EB3 category cut-off date has advanced extremely rapidly during the past seven months. This has resulted in a dramatic increase in applicant demand for I-140 petitions.

Lately, our law firm helped a postdoctoral molecular biologist receive the CIS approval notice of EB2NIW petition in 7 months without a Request for Evidence (RFE). The client’s I-140 EB2NIW application was filed on October 4, 2013 and approved on May 8, 2014.

At the time of filing the petition, the applicant was working as a postdoctoral research associate at a U.S. university. The applicant received a M.S. degree in Microbiology and Ph.D. degree in Dental Science. As a distinguished molecular biologist, the applicant is currently playing a critical role in the important projects funded by government agencies such as the U.S. Department of Defense (DoD) and the National Science Foundation, as well as the American Heart Association (AHA), a nonprofit organization.

The alien/applicant has made original scientific research contributions to the development of neuron and stem cell differentiation. The applicant’s research work is of high importance to the national interest of the United States, in the area of health care, particularly in the research on brain cell signaling in traumatic brain injury. The applicant’s research on traumatic brain injury has practical significance in developing new TBI detection strategies and treatments and has a direct link to the U.S. long-term interest in health care.

The applicant has been investigating signal transduction in neuronal response to traumatic brain injury, and stem cell differentiation in response to biomaterials and mechanical stimulation. Traumatic brain injury (TBI) is a major problem in the United States with 1.4 million injuries reported annually. TBI is also a major concern for military personnel in combat scenarios. Blast-induced TBI is a common event in combat scenarios, many of which involve improvised explosive devices. Understanding the signal transduction in brain cells in response to blasts is of significant national interest. The applicant’s research studies contribute to designing better protective equipment and to developing new TBI detection and remediation strategies.

To prove that the applicant’s research achievements have substantial degree of impact/influence on the field as a whole, we thoroughly documented research achievements, including 14 journal publications, 18 conference abstracts/proceedings, review/research citations, and 6 expert opinion letters, among other documents.

The fact that the applicant’s I-140 EB2NIW petition was approved in 7 months without a RFE reflects the fact that the case was well-prepared and well-organized by our successful systematic evidence preparation.

The EB2NIW applicants who are outside the United States (e.g. in Korea) do not need a U.S. employer to sponsor a green card application. However, the applicant needs to have a U.S. institute provide a ‘Letter of Intent to Offer’ to USCIS to prove that he/she will be offered a research position in his/her field of specialty in the United States after obtaining a green card.
